Trump favors #pardon seekers w/connections to him—either personally or through lawyers & lobbyists—& claims of *prosecutorial misconduct* [perceived persecution] that echo his own #grievances about the cases against him.

But #Trump himself did not speak to that issue when he signed the proclamation issuing the #pardons, & it has left his own admin & the courts struggling to divine what was in his head…. []

Asst US Atty Blackwell said the #DOJ’s understanding of Trump’s #pardon had *evolved* in recent wks — but she did not say how or why. She said this shift was the reason DOJ had moved in recent days to drop a slew of other cases against #Jan6 defendants who were on the hook for other federal #felonies.

The abrupt reversal prompted a federal judge — now weighing Wilson’s last-minute effort to avoid prison for the #gun conviction — to demand answers from the #Trump admin on Wed: Who exactly did Trump mean to #pardon when he signed his sweeping #clemency order last month, & for what #crimes?

During a 2-hr hearing in her federal courtroom, US District Judge Dabney Friedrich—a Trump appointee—grilled a #DOJ atty about the matter & appeared to leave with more questions than answers.

3 weeks ago, the #DOJ was emphatic: #Trump may have pardoned Kentuckian Dan Wilson for #crimes he committed at the Capitol on #Jan6, but that #pardon did not extend to his unrelated conviction for illegally storing #firearms at his home.

Then, on Tues, the US atty in DC [#EdMartin] reversed course, saying it had “received further clarity” about Trump’s true intent, which included pardoning Wilson for the #gun case. Prosecutors did not explain how they arrived at this new “clarity.”

Kelley was among the >1,500 defendants who received a #pardon from #Trump on Jan 20 for their actions during the #Jan6 #insurrection.….

Kelley’s attorney has argued that Trump’s mass pardon of Jan. 6 *rioters* should apply to Kelley’s #conviction in the #murder plot because it “directly relates to the events at the United States Capitol on January 6, 2021.”

Prosecutors wrote that Kelley "devised a plan to murder federal, state, & local law enforcement in East Tennessee."

The #DOJ said evidence at trial showed Kelley developed a “kill list” of #FBI special agents & others who investigated his conduct. “Every hit has to hurt,” Kelley said to a co-conspirator…. “Every hit has to hurt.”
